By using SiteScore (sitescorehq.com), accessing our free website builder, or purchasing any of our paid plans, you agree to these Terms of Service. Read them carefully. If you do not agree, do not use our services.
1. Who We Are
SiteScore ("we," "us," "our") is a website building, hosting, and digital marketing service for small and local businesses. We provide AI-assisted website creation, hosting, SEO services, and Google Ads management. We are based in California, United States.
2. Definitions
- Service: Any product or feature offered through sitescorehq.com, including the free website builder, audit reports, hosting, SEO, and Google Ads management.
- Customer: Any individual or business who uses our Service, whether free or paid.
- Preview Site: A free, AI-generated website hosted on a SiteScore subdomain.
- Live Site: A website hosted under a paid plan on the customer's own domain.
- Content: All text, images, logos, and other materials displayed on or generated by the Service.
3. Eligibility
You must be at least 18 years old and have the legal authority to enter into binding agreements to use our Service. You must provide accurate, current, and complete information about yourself or your business.
4. Free Website Builder Limits
Reasonable usage limits apply to all free services to prevent abuse and ensure availability for all users.
- Free preview website builds are limited to 3 builds per IP address per day.
- Each business may receive one (1) free preview website. Subsequent rebuilds for the same business are at our discretion.
- Total daily free builds across our platform are capped at 50 sites per 24 hours. If the daily cap is reached, you may try again the following day.
- Free preview sites are hosted on a SiteScore subdomain (e.g., sitescorehq.com/preview/yourname). They cannot be served from a custom domain without a paid plan.
- Free preview sites may be removed without notice after 90 days of inactivity or if abuse is detected.
- The free website audit and scanner tools are limited to 10 scans per IP address per day.
- We reserve the right to refuse, modify, or discontinue any free service at any time, for any reason, without notice.
5. Paid Plans
5.1 Subscription Pricing
Our recurring plans are billed monthly in advance via Stripe and include:
- Hosting + Maintenance: $147.00/month USD
- SEO + Local Rankings: $297.00/month USD
- Google Ads + SEO: $497.00/month USD (advertising spend not included)
One-time charges include the Full Website Audit at $97.00 USD.
5.2 Billing
- All payments are processed by Stripe and charged in US Dollars.
- Your subscription renews automatically each month until canceled.
- Failed payments will be retried up to 4 times before subscription cancellation.
- Prices are subject to change with 30 days' notice via email.
5.3 Cancellation
You may cancel any monthly subscription at any time by emailing hello@sitescorehq.com. Cancellations take effect at the end of the current billing cycle. We do not provide pro-rated refunds for partial months.
5.4 Refund Policy
All purchases are final. Due to the immediate delivery of digital services and AI-generated content, we do not offer refunds except where required by law or at our sole discretion in cases of clear service failure.
One-time products like the Full Website Audit are non-refundable once delivered. Subscription cancellations stop future billing but do not refund prior charges.
6. Service Limits and Fair Use
Reasonable usage policy: Our paid plans are designed for typical small business usage. Excessive resource consumption may result in additional charges or service suspension.
6.1 Hosting Plan Limits
- Up to 50,000 page views per month per hosted site
- Up to 5 GB of bandwidth per month
- Up to 2 monthly content updates (text or image changes)
- One website per subscription
6.2 SEO Plan Limits
- Up to 2 SEO content posts per month (blog posts or page additions)
- Up to 10 target keywords tracked monthly
- Includes Google Business Profile optimization for one (1) location
- One monthly performance report
6.3 Google Ads Plan Limits
- Up to 3 active ad campaigns simultaneously
- Advertising spend is paid directly to Google by you and is not included in our management fee
- One A/B test per month
- One monthly campaign report
6.4 Exceeding Limits
If your usage consistently exceeds these limits, we will contact you to discuss an enterprise plan or additional fees. We reserve the right to throttle, suspend, or terminate accounts that exceed reasonable use.
7. AI-Generated Content Disclaimer
Our websites are built using artificial intelligence. By using our Service, you acknowledge and agree to the following:
- Generated content may contain inaccuracies, errors, or content that requires editing.
- You are responsible for reviewing and approving all content before going live.
- We do not guarantee that AI-generated content will be unique, error-free, or fit for any particular purpose.
- You are solely responsible for ensuring the accuracy of business information, claims, certifications, licenses, and any factual statements on your website.
- Stock images used are licensed from Unsplash under their license terms. We do not represent that images depict your actual products or work.
8. Acceptable Use Policy
You may not use our Service to:
- Build websites for illegal businesses or activities
- Promote violence, hate speech, harassment, or discrimination
- Distribute malware, phishing content, or perform fraud
- Infringe on copyrights, trademarks, or intellectual property of others
- Sell counterfeit goods, illegal drugs, weapons, or regulated products without proper licensing
- Operate adult content, gambling, or cryptocurrency-related sites
- Spam, scrape, reverse-engineer, or attempt to bypass our rate limits
- Resell our Service to third parties without written permission
Violation of this policy will result in immediate service termination without refund.
9. Intellectual Property
9.1 Your Content
You retain ownership of all content you provide to us (business name, logos, photos, descriptions). You grant us a limited license to use this content solely to provide the Service.
9.2 Generated Websites
Once you have an active paid plan, you have a perpetual license to use the website we build for you for your business. If you cancel your hosting plan, you may export the static HTML files but lose access to ongoing maintenance, updates, and any custom domain configuration.
9.3 Our IP
The SiteScore platform, brand, software, and design system remain our exclusive property. You may not reproduce, modify, or create derivative works of our platform without written permission.
10. Service Availability
We strive for 99% uptime but do not guarantee uninterrupted Service. We are not liable for downtime caused by:
- Scheduled maintenance (we will provide advance notice when possible)
- Third-party service outages (Netlify, Stripe, Google, Anthropic, etc.)
- Internet connectivity issues
- Force majeure events (natural disasters, war, pandemic, government actions)
11. Disclaimer of Warranties
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Your website will achieve specific search rankings or traffic levels
- Google Ads campaigns will achieve specific results or ROI
- AI-generated content will be free from errors
12. Limitation of Liability
Our total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow limitations on certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless SiteScore, its operators, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Content you provided that infringes third-party rights
- False or misleading business claims on your website
- Your violation of any law or regulation
14. Account Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if:
- You violate these Terms
- Your payment fails and is not resolved within 7 days
- We detect fraudulent or abusive activity
- We discontinue the Service
Upon termination, your access to hosted websites and services ceases. We may delete your data 30 days after termination.
15. Modifications to These Terms
We may update these Terms at any time. Material changes will be communicated via email or notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
Any disputes will be resolved through binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits or class-wide arbitration.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SiteScore regarding the Service.
